Governor jj transferred mayor yy, an accused in criminal case no. 10963 for murder, from the provincial jail of surigao to the residence of the governor. hence, criminal charges were filed against the governor for violation of section 3(e. of republic act (r.a.) no. 3019, otherwise known as the anti-graft and corrupt practices act, as amended. the governor however made the following contentions: first: section 3(e., r.a. no. 3019 does not apply to his case because the provision contemplates only transactions of a pecuniary nature. since the law punishes a public officer who extends unwarranted benefits to a private person, he cannot be held liable for extending a favor to mayor y, a public officer. second. he claims good faith in taking custody of the mayor considering the imminent threats on the life of the mayor and the dangers posed by his detention at the provincial jail.
